国際法上の戦争ではない』『戦争捕虜ではなく匪賊である』『捕らえた中国軍兵士を即時処刑しても問題ない』という日本側の認識が盧溝橋事件(The Marco Polo Bridge Incident)後も変わらなかったことを示すのがこの節である。

The Policy Remained Unchanged After The Marco Polo Bridge Incident

Both the League of Nations and the meeting at Brussels of the signatories of the Nine-Power Treaty railed to stop Japan's pursuing this "punitive" war on China after the outbreak of hostilities at the Marco Polo Bridge in 1937. This policy of Japan to treat the China war as an "incident" remained unchanged. Even after the establishment of the Imperial General Headquarters, which was considered appropriate only in the case of an "incident" of such an extent as to require a declaration of war, as suggested by the War Minister at the cabinet meeting held on 19th November 1937, no additional effort was made to enforce the laws of war in the conduct of the hostilities in China. Although the Government and the fighting services were organized on a full wartime basis, the China war was still treated as an "incident" with the consequent disregard of the rules of war.

1937年の盧溝橋(The Marco Polo Bridge)での軍事行動勃発後、国際連盟と9カ国条約締約国によるブリュッセル会議は共に、日本による中国に対するこの「膺懲」戦争を止めようとした。日中戦争を「事変」として扱う日本の政策は変わらなかった。宣戦布告を必要とする程度の紛争に際してのみ設置できる大本営(the Imperial General Headquarters)が設置後でさえ、1937年11月19日の閣議で陸軍大臣が提案したように、中国に対する軍事行動に戦時国際法を適用するための努力は何らなされなかった。政府と軍部は完全な戦時体制に移行したにもかかわらず、日中戦争は未だに戦時国際法が無視された「事変」として扱われた。

解説

「the Nine-Power Treaty」とは1922年2月6日調印の「中国に関する九カ国条約」のこと。盧溝橋事件の後も日本は、日中戦争を「事変」であり戦争ではない、戦時国際法を適用する必要はない、と強弁していた。当時の大本営条例では大本営の設置は戦時(宣戦布告を伴う戦争)に限定されていたが、1937年11月18日にこれを廃止し、新たに戦時以外の事変でも大本営を設置可能とする大本営令が制定された。こうして11月20日に大本営が設置されている。
